Multi Wellness Center has filed a lawsuit against Yerevan Municipality, challenging the decision that revoked its development rights and transferred the site to the administration of the Yerevan Municipality.
According to the Datalex judicial information system, the company’s representative is asking the court to invalidate the transaction carried out by the Mayor of Yerevan on June 8, under which the municipality unilaterally terminated the agreement signed with detained businessman Gagik Tsarukyan, RFE/RL reported.
Tsarukyan’s lawyer is also asking the court to invalidate the Cadastre Committee’s decision, under which Multi Wellness’s development rights were terminated on July 14 and the entire property was registered as the ownership of the Yerevan municipality. The Cadastre Committee has not commented on its decision.
Several weeks ago, Yerevan Municipality terminated the lease agreement with Multi Wellness, a company owned by Tsarukyan. Last weekend, Mayor Tigran Avinyan announced that the complex had reopened under a new name and would operate under the supervision of the capital’s authorities. At the same time, under a 2016 land lease agreement, the company had obtained development rights to the site until 2065. However, under Avinyan’s decision, Tsarukyan lost not only the land plot but also the building constructed on it and the property located inside.
Yerevan Municipality has not clarified the legal grounds for these changes or whether the agreement contained provisions allowing such actions.
The case has been assigned to Judge Arshak Petrosyan, but the date of the court hearing has not yet been announced.
Earlier, it was reported that property belonging to Gagik Tsarukyan’s family had been transferred to state administration as part of proceedings on the confiscation of assets alleged to be of unlawful origin.
